New and Pending State Laws
California passed the new Delete Act law October 10, 2023, with the new rules phasing in this year. Consumers are able to to use one tool to remove their data from approximately 500 different data-broker sites.
Legal Loophole Offenders
Forewarn grants unearned, unelected power to realtors who can quietly correct errors in their own unaccountable reports, while consumers are met with unreasonable obstacles to the truth about their own background that is related to legal contracts and housing issues. Even more disturbing, a consumer may never know that false data is present and requires correction.
In a 2024 study (pre-print 2023) by Lageson and Stewart in Criminology, findings suggest that unregulated background checks were wrong with false positives 50 percent of the time and regulated background checks were wrong with false positive 60 percent of the time, regulated providers having a financial incentive to over-report. Given the degree of possible error and lack of accountability, relators who use Forewarn have a fee pass to discriminate and engage in malicious gossip without recourse. This is the new face of neighborhood steering. Even judges, who we hold in high esteem in our communities, who have decades of education and accountability to the public, whether elected or appointed, don’t have this kind of power related to PII (stay tuned for more information about Forewarn).
